NANO Datacenter denominated here below as NANO Datacenter, NANO DC or NDC with its headquarter located at Rue Des Ponts 16, 7850 Enghien, Belgium registered with VAT BE0820347608

Service Level Agreement

NANO Datacenter will always try to provide the best SLA it can however some products are subject to specific SLA as follow:

The 99,9% SLA correspond to a 43 minutes and 49 seconds downtime per month or 8h 45m 56s on a yearly basis

The 99,99% SLA correspond to a 4m 22s downtime per month or 52m 35s on a yearly basis

The 99,999% SLA correspond to a 26s downtime per month or 5m 15s on a yearly basis

Refund can be asked in the case NANO Datacenter doesn’t meet the SLA sold with its products. The refund must be asked by writing no later than 5 business days after the outage has taken place. The refund is based on the below table. No refund is eligible for cash refund but rather under the form of a coupon that can be used on our web shop.

Outage starts when the customer, who has notified NANO Datacenter of an issue on its product, receives the acknowledgement from NDC a confirmation that an issue is ongoing.

Available SLA; 99,9% ,99,99%, 99,999%, SLA valid on connectivity and power feed(s)

NANO – 3RU

Available SLA; 99,9% ,99,99%, 99,999%, SLA valid on connectivity and power feed(s)

Liability

The court of Mons, Belgium is the only one to be seized in the event of proceedings against NANO Datacenter.

NANO Datacenter shall not be liable for an amount of more than 500 euros.

Customer

Customer shall prepay its product through NDC’s web shop. The service is assured through an auto renewal of the customer’s subscription on a monthly or yearly basis.

The customer has the possibility to stop this automatic process. However in such a case if the customer doesn’t prepay its services on time, NDC reserves the rights to disconnect the customer’s device and assign its resources to another customer.

The customer shall be notified by email maximum 5 days after NDC noticed the missing payment.

At this moment NDC will send out an invoice to the customer to cover the fee in order to return the customer’s hardware.

In the event of which the customer will not pay this invoice within 30 days, and after 2 written (email) reminders, NDC reserves at its sole discretion to retain the hardware of the customer in order to cover the fee related to the unpaid invoice.

This doesn’t involve any liability in regards to NDC.

Abuse

Any abuse should be reported to bv@nano-datacenter.com and will not involve NDC’s liability. Our customers shall respond to any abuse reported when the abuse is linked to an unlawful usage of the IP that has been assigned to them.

Change

These term can be changed at our own discretion without any prior notification. Customers shall regularly check this page to be up to date with our terms.
